It is understood that:

1. The rate and other charges for my stay is the amount for which I am responsible. I agree that my liability for charges is not waived and agree for the full amount of charges and/ or damages by me or any of my guests, to my suite, be debited to the authorized credit card or billing account on file, should Skyward Living Properties Inc. be unable to reach me for payment.

2. One key FOB for each registered adult guest noted will be provided. I agree that I am responsible for the replacement cost of $150.00 for each parkade FOB and $75.00 for each door entry key FOB.

3. Cancellation and refund terms are based on length of stay and notice is required before 11:00 AM for the following to ensure full refund:
a. 1-6 nights require 24-hour notice
b. 7-14 nights require 3-day notice
c. 15-29 nights require 7-days notice
Failure to provide sufficient notice of cancellation will result in a forfeiture of refund.

4. Please note the following defined cancelation policies or cancelled trips or early departures due to circumstances beyond the control of Skyward Living Properties Inc. This includes but is not limited to: weather; acts of nature; local events; illness or injury; power outages; death in the family; or changes in Guests’ schedule. Skyward Living Properties Inc. will attempt to accommodate changes in Guests plans when feasible.

5. Check in time is 3:00 pm on the first day of your stay. Check out time is 11:00 am on the last day of your stay. Guest agrees to depart on time. A delayed checkout interrupts the cleaning schedule and a fee will be charged. Refer to attached Fee Schedule.

6. If the Guest desires to extend their stay, Guest shall contact Skyward Living Properties Inc. Customer Service at 780.628.2542 or no less than 24 hours prior to scheduled departure. Skyward Living Properties Inc. personnel must confirm such extension. Failure to vacate the unit when scheduled will incur charges equal to double the base nightly rate. Please refer to attached Fee Schedule. Guest agrees to follow the departure procedure specified by Skyward Living Properties Inc. when vacating the property both during the stay and upon final departure. The residence shall be secured by locking all doors and windows. Upon final departure the keys shall be returned to the lockbox or the onsite property manager.

7. The Guests shall maintain the premises in a good, clean condition and use the premises only in a careful and lawful manner.

8. Guest agrees to be a good neighbour by respecting the rights of the surrounding occupants to a pleasant, safe and peaceful environment. The Guest shall not create noise or other situations likely to disturb or annoy the surrounding neighbours.

9. Guests shall dispose of all garbage generated during the rental period in the trash receptacles provided.

10. Guest shall not have any additional persons reside or sleep over at the property other than the number of adults and children specifically claimed in the reservation. If the Guest wishes to have additional persons stay over for all or part of their rental term they can do so (up to the number allowed in the property by Skyward Living Properties Inc.) with the express knowledge and consent of Skyward Living Properties Inc. Each authorized additional guest may incur an additional guest fee per night.

11. Guest agrees that no animals or pets shall be brought onto the premises without prior approval from Skyward Living Properties Inc. This is for the benefit of our future Guests that may have allergies to pets. If we find that pets have been staying on the premises, guests will incur a supplemental cleaning fee.

12. Guest agrees that there shall be no smoking inside any Skyward Living Properties Inc. property, including vaping, smudging, and/or cannabis products. Any indication of smoking will result in a minimum $500 cleaning charge for upholstery, curtains and rugs and any additional costs to remedy the situation up to and including immediate eviction.

13. Any damages to the property may result in charge backs to the credit card on file. Legitimate reasons for chargebacks include:
a. Checkout cleaning fees
b. Damage to the property
c. Any indication of smoking in the property
d. Any unapproved pets on the property
e. Unpaid rent
f. Missing items
g. Abandoned property
h. Higher than customary post-stay cleaning costs

14. Some consumables such as coffee, tea, salt and pepper, paper towels, toilet paper, soap, dish detergent, garbage bags and laundry soap, may be provided; however, it is the Guest’s responsibility to replenish if they run out during the stay.

15. Wi-Fi is provided in all properties. Skyward Living Properties Inc. shall attempt to remedy any disruption in service at the earliest opportunity. No refund shall be given for outages, speed, access problems, lack of knowledge of use, or personal preferences regarding internet service.

16. All properties have working smoke alarms which are believed to function properly at the time of rental. Guest shall familiarize themselves with the location and operation of any fire extinguisher(s) upon arrival. Guest shall notify management without delay if a fire alarm “chirps” or has a low battery condition. Tampering with either the smoke or water sprinkler systems in the suite will result in an automatic eviction and a $250 fine.

17. The property shall not be used to engage in any unlawful activity. Any such activity shall be grounds for immediate eviction as set out in the Innkeepers Act and guests will be asked to vacate the premises immediately without refund.

18. Guest shall allow Skyward Living Properties Inc. to access the property for purposes of maintenance, repairs, improvements, in cases of violations in accordance to the Innkeepers Act or to show it to future potential guests. Skyward Living Properties Inc. shall exercise this right of access in a considerate and reasonable manner by contacting Guest in advance in all situations except violations of the Guest Contract.

19. Skyward Living Properties Inc. has the right to inspect the premises without prior notice to enforce the terms of this Agreement. Guest waives all rights to process upon failure to vacate the premises upon termination of the rental period, including early termination due to breach of this Agreement.

Skyward Living Properties Inc. cannot be held responsible for
i) The failing of any other company’s service due to said company’s error or service interruption (i.e. electricity, water, gas, Wi-Fi, cable etc.),
ii) Activity from neighbors, for example construction, noise, road repair, or maintenance.
iii) Acts of nature such as adverse weather, hurricanes, flooding.

20. On rare occasions a unit will become unavailable in situations beyond the control of Skyward Living Properties Inc. such as a major appliance failure, utilities failure or unit damage. Under these circumstances Skyward Living Properties Inc. shall make every effort to accommodate affected guests in another Skyward Living Properties Inc. unit.

21. Guest shall hereby indemnify and hold harmless Skyward Living Properties Inc. and their agents against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss.

22. Guest agrees to pay all reasonable costs, attorney’s fees and expenses incurred Skyward Living Properties Inc. in enforcing this Agreement.

The Parties, intending to be legally bound, do hereby agree to the Terms of Agreement set out by the Inn Keepers Act and swear or affirm that the information provided through the booking website is true. Any changes in the information provided including but not limited to the number of guests and age of any children must be communicated to Skyward Living Properties Inc. Customer Service at 780-628-2542 or
